LAND O'LAKES -- It will be two years before he can legally drive and seven years before he can legally drink, but a 14-year-old Tampa boy was charged with doing both Friday night.

At about 11:15 p.m. an off-duty Tampa police officer saw the boy, who is not being named by the St. Petersburg Times because of his age, swerving in and out of the lanes while driving north on U.S. 41, according to Pasco County sheriff's deputies.

The officer called deputies for assistance.

A deputy driving in the opposite direction had to swerve off the road to avoid the boy, who was driving his brother's 1993 Ford Taurus, deputies and the boy's brother said. The deputy turned around and tried to stop the boy.

The boy continued to swerve into oncoming traffic on U.S. 41 until he stopped. He was arrested near the entrance to Land O'Lakes High School, deputies said.

The boy's breath tests showed a blood alcohol level of .094 and .095, according to deputies. Florida law assumes impairment at .08 for drivers who are old enough to drink alcoholic beverages.

"We've got a little bar and probably he was drinking out of that," the boy's 28-year-old brother told the Times on Saturday. "Believe me, he's going to get in big trouble."

The boy took his brother's car without permission, the brother said.

The boy was cited for driving under the influence and driving without a license and was released to the custody of his brother, deputies said.
